Students
should never view themselves as living in a time or space enclave which protects
them from consequences of any illegal behavior. Campus, city and state enforcement
authorities work in partnership to uphold both campus and applicable local,
state, and federal laws. For more detailed information about the following laws
you can review: 1) City of Berkeley Municipal Codes - www.ci.berkeley.ca.us/BMC
and 2) California Business & Professions Code - www.leginfo.ca.gov/calaw.html. Noise
Laws Noise complaint: If police are called because of a noise complaint,
the officer initially responds to corroborate the "unreasonable" noise
reported by the person who complained. The criteria include loudness, pitch, duration,
time of day, and necessity of the noise. If the officer corroborates that the
noise is unreasonable: 1st response - warning; 2nd response - up to $100 fine.
(BMC 13.40.030) Second
Response Ordinance - Public Nuisance Gathering:
If police are called because of a loud or unruly gathering, the officers
initially respond to determine if it is a gathering of 10 or more people
that hinders the "quiet enjoyment of private or public property".
The criteria include excessive noise or traffic, obstruction of public
streets by crowds or vehicles, public drunkenness, serving alcohol to
minors, fights, disturbances of the peace, and/or litter. If the officers
determine the gathering is a public nuisance (BMC 13.48.020), you are
subject to the Second Response Ordinance (BMC 13.48.050): 1st offense
- usually a warning, public notice (required to post "Exhibit A"
in plain sight at the property), and order to disperse; additional offenses
that night or within 120 days - automatic fines of $750-$2500 (BMC 13.48.050)
